By accessing or using Gouash ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Gouash is an AI-powered interior and architectural design platform that allows users to:

• Generate interior design concepts using artificial intelligence
• Transform existing spaces with AI-enhanced designs
• Create and manage design projects
• Export and download generated designs
• Access the service via web application and Windows desktop application
• Integrate with third-party applications via API

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Keep your password confidential and secure
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Credits and Payment

4.1 Credit System

Our Service operates on a credit-based system. Credits are required to generate designs and access premium features. Credit costs vary by feature:

• Design generation: 1 credit per render
• Design editing: 1 credit per edit
• Video animation: 3 credits per video

4.2 Subscription Plans

We offer various subscription plans with monthly credit allocations. Subscription benefits and pricing are detailed on our pricing page. Unused credits do not roll over to the next billing period unless specified in your plan.

4.3 Payments and Refunds

All payments are processed through PayPal. Refunds are handled on a case-by-case basis. Credit purchases are generally non-refundable once credits have been used. Subscription cancellations take effect at the end of the current billing period.

5. Intellectual Property Rights

5.1 Your Content

You retain ownership of all images you upload and designs you create using our Service. By uploading content, you grant us a limited license to process, store, and display your content solely for the purpose of providing the Service.

5.2 Generated Designs

Designs generated through our AI service are owned by you. You may use generated designs for personal and commercial purposes. However, you acknowledge that similar designs may be generated for other users due to the nature of AI generation.

5.3 Platform Content

All platform content, including but not limited to software, design, graphics, and text, is owned by Gouash or our licensors and is protected by intellectual property laws.

6. Acceptable Use Policy

You agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Create designs containing violence, nudity, hate speech, or discriminatory content
• Infringe upon the intellectual property rights of others
• Upload malicious software or attempt to compromise our systems
• Circumvent usage limits or abuse the credit system
• Share your account credentials or allow unauthorized access
• Use automated tools to access the Service without permission
• Impersonate any person or entity
• Collect or harvest user information without consent

7. API Usage

If you use our API, you agree to the following additional terms:

• Keep your API keys confidential and secure
• Comply with rate limits and usage quotas
• Not resell or redistribute API access without authorization
• Attribute Gouash where required by API documentation
• Accept that API availability may change with notice

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any aspect of the Service at any time. We are not liable for any service interruptions or data loss.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that AI-generated designs will be suitable for any particular purpose, structurally sound, or compliant with building codes or regulations. Professional consultation is recommended before implementing any designs.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOUASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gouash and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination shall survive.

You may terminate your account at any time through your profile settings. Account deletion is permanent and results in loss of all data, credits, and designs.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Gouash is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of that jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
